ORDINANCE NO. O2022-12
AN ORDINANCE AMENDING THE WARRENVILLE ZONING ORDINANCE
TO PROHIBIT BARBED AND RAZOR WIRE ON FENCES IN RESIDENTIAL DISTRICTS
 
   WHEREAS, the City is a home rule municipal corporation in accordance with Article VII, Section 6(a) of the Constitution of the State of Illinois of 1970; and
   WHEREAS, the City of Warrenville Zoning Ordinance, as amended ( “Zoning Ordinance” ), is codified as Title 10 of the Warrenville City Code; and
WHEREAS, Section 10.10.A.8.F.3 of the Zoning Ordinance sets forth regulations regarding fences in residential zoning districts within the City; and
WHEREAS, the City desires to amend Section 10.10.A.3.B of the Zoning Ordinance to prohibit the use of barbed wire and razor wire on fences in residentially zoning districts ( “Text Amendment” ); and
WHEREAS, pursuant to notice duly published in the Daily Herald on March 9, 2022, the Plan Commission conducted a public hearing on March 24, 2022, to consider the Text Amendment; and
 
WHEREAS, at the conclusion of the public hearing, after considering all of the testimony and evidence presented at the public hearing, the Plan Commission recommended that the City Council approve the Text Amendment; and
   WHEREAS, the Mayor and the City Council have considered the recommendations of the Plan Commission and all of the materials, facts, and circumstances relating to the Text Amendment, and find that it is in the best interest of the City and the public to approve the Text Amendment and amend the Zoning Ordinance in the manner provided in this Ordinance;
 
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF WARRENVILLE, DUPAGE COUNTY, ILLINOIS, AS FOLLOWS:
SECTION ONE:   Recitals.  The recitals listed above are incorporated in this Ordinance as if fully set forth in this Ordinance.
SECTION TWO:   Amendments to Section 10.10.A.3.B. Section 10.10.A.3.B, titled “Fences,” of Chapter 10, titled “Accessory Uses and Structures,” of the Zoning Ordinance is hereby amended as follows:
 
“B.   Fences.
 
The maximum height of a fence in a Residential District, measured from the finished grade at the fence post, shall be 6 feet, except fences abutting a railroad right-of-way or along the edge of a utility easement that adjoin and run parallel with a railroad right-of-way shall be a maximum of 8 feet in height. Fences shall display the finished side toward the abutting property except that, for properties abutting a railroad right-of-way or along the edge of a utility easement that adjoins and runs parallel with a railroad right-of-way, the finished side may be displayed toward the property. The height of protection fencing/backstops shall not exceed 30 feet for baseball and softball fields, 16 feet for batting cages, 12 feet for tennis courts, and 10 feet for all other recreational equipment. The installation and use of razor wire and barbed wire on fences is prohibited in Residential Districts.
 
SECTION THREE:   Effective Date.  This Ordinance shall be in full force and effect following its passage, approval, and publication in pamphlet form in the manner required by law.
