3-9-10: REVOCATION OR SUSPENSION OF LICENSE:
The city council, upon the recommendation of the mayor or some person or committee delegated by the mayor to carry out the functions ascribed to the mayor pursuant to this chapter, may revoke or suspend any license issued by the city to the owner or operator of a game room. If a committee is delegated, the mayor may serve on the committee. The committee shall determine which member shall write its recommendation to the city council. Provided, however, that no such license shall be so revoked or suspended except after a public hearing conducted by the mayor or a designee with not less than a three (3) day written notice to the licensee affording the licensee an opportunity to appear and defend. After conducting the hearing, the mayor or designee shall prepare a report summarizing the evidence and making a recommendation to the city council. The city council may accept the recommendation of the mayor or designee or by motion revoke or suspend the license for a period other than that period recommended by the mayor or designee. In any instance where an alleged violation is the first charge attributable to the premises, the mayor or designee, after a hearing as provided above and without the need for a consideration of the matter by the city council, may suspend the license of the game room for a period of not to exceed seven (7) days.
Provided further, that if the mayor has reason to believe that any continued operation of the game room will immediately threaten the welfare of the community, he may, upon the issuance of a written order stating the reason for such conclusion and without further notice or hearing, order the licensed premises closed for not more than seven (7) days, giving the owner and operator an opportunity to be heard during that period. In the event that the license to a game room is revoked either through the revocation of the license of an owner or operator, no new license for a game room shall be issued for the premises within a period of one year from the date of the revocation.
