§ 93.16  EXCAVATION REQUIREMENTS; DEPOSIT REQUIRED.
   (A)   All excavations made in any street shall be done in a good and workmanlike manner, and the excavation so made shall be carefully filled and thoroughly tamped or otherwise settled to the satisfaction of the head of the Street Department, who shall be notified before any part of the excavation has been filled so that he can be present when the same is filled and it shall be his duty to see that said work is done properly.
   (B)   The deposit provided for herein shall be held by the Clerk-Treasurer for a period of 30 days after any tap has been made or other work done and the street refilled and otherwise restored as provided herein and until the head of the Street Department has inspected the same.  If, after 30 days, the head of the Street Department finds that said street has not been repaired as provided herein, he shall promptly restore the street to the same condition as the balance of said street and shall keep an accurate account of the costs of repairing said street and present the same, including the wages of the town employees for the time they spent repairing said street, to the Clerk- Treasurer.  Those costs shall be paid out of the owner's deposit, whereupon the balance of that deposit, if any, shall be restored to the property owner entitled to receive it.  If the head of the Street Department determines, upon making the inspection at the end of 30 days, that said street has been properly repaired, he shall so report to the Clerk-Treasurer and said property owner shall be entitled to receive his deposit.
