§ 93.02  CONSTRUCTION AND REPAIR OF SIDEWALKS.
   The owner or owners of any parcel of land abutting on any street or public highway within the corporate limits of the town are required, when ordered by the Town Council, to contract and maintain a sidewalk along such parcel of land as hereinafter provided.
   (A)   Construction.  All sidewalks built within the town shall be constructed of the materials determined by the Town Council by order, resolution, or ordinance; and all sidewalks shall be constructed under the direction of the Town Marshal and subject to the approval of Council.  The Town Council, or any competent engineer or surveyor appointed by it, shall fix the grade of all sidewalks built or replaced within the town.
   (B)   Repair.  All public sidewalks within the limits of the town, whether constructed under special resolution or otherwise, shall be under the supervision of the Town Marshal, and when any sidewalk is grossly out of repair it shall be the duty of the Town Marshal to notify in writing the owner or occupant of the adjacent parcel of land to repair said sidewalk. If said owner shall fail or refuse to repair said walk within a reasonable time thereafter, then the Town Marshal shall report the matter to the Town Council, and the President of the Town Council shall call a meeting of the Town Council to discuss the matter.  The Town Council shall proceed to rebuild, improve, or repair said walk as provided by law, and shall charge the lot owner for the costs thereof.
