§ 31.05  CLERK-TREASURER.
   (A)   Establishment of office of Clerk-Treasurer.
      (1)   Both the office of Clerk and Treasurer shall be held and administered by one and the same person.
      (2)   Said officer shall be known and designated as the Clerk-Treasurer of the Town of Warren, Indiana.
      (3)   The salary of the Clerk-Treasurer shall be as determined from time to time by the Town Council, and as updated and amended from time to time.
   (B)   Duties of the Clerk- Treasurer.
      (1)   The  Clerk- Treasurer shall keep the books and records of the town's electric, water and sewage utilities; collect the electric, water and sewage bills for the town; collect all deposits for meters before the lights or water are turned on, and make all funds so collected chargeable against the Clerk-Treasurer's office.  The Clerk-Treasurer shall perform all other duties pertaining to the operation of the electric, water and sewage utilities as the Town Council may from time to time by resolution require.
      (2)   He shall keep a complete journal of all proceedings of the Town Council entered at length, and the President shall sign and the Clerk-Treasurer attest the record of each meeting of the Council, whenever the same shall have been read and approved.
      (3)   He shall file and preserve all reports of committees and petitions, and he shall file and record all resolutions, orders, ordinances, bylaws or other enactments passed by the Town Council.
      (4)   He shall see that all bills are properly prepared and approved by Council.  When the claim is allowed, he shall then issue a check.  He must number each bill in consecutive order and record the same.
      (5)   He shall have the custody of the town seal and all the records, books, and papers of the Town Council belonging to the town.  He shall properly index journal records and keep all other papers in classified order.  Whenever an ordinance or order has been modified or repealed, he shall note the fact on the margin of the record, giving date and page for reference.
      (6)   He shall issue all notices to property owners for street, sidewalk and sewer improvements and cause the same to be published or served by the Town Marshal, as provided by law, or as ordered by the Town Council.
      (7)   He shall issue licenses authorized by the town ordinances, fixing the amount to be paid, to whom issued, and under what ordinance.  He shall keep a record of the same, and when so issued shall charge the Clerk-Treasurer's office with the amount before he delivers said license.
      (8)   He shall receive and receipt all moneys belonging to the town, as well as all special funds belonging to contractors for street, sidewalk, and sewer improvements or to bondholders for payment of bonds or coupons, and he shall charge the Clerk-Treasurer's office with all moneys so received.  He shall pay out no money except on a claim properly drawn on the funds and presented to and allowed by the Town Council.
      (9)   He or she shall receive and receipt semiannual tax moneys and charge the amount to different funds as designated by the County Auditor.
      (10)   The Clerk- Treasurer is authorized to deposit any and/or all funds in any bank so designated as a state depository by the state.
      (11)   It shall be the Clerk-Treasurer's further duty, on demand of the Town Council or on demand of the State Board of Accounts, to submit a brief report of the financial condition of the town, showing the amounts in the different funds and the outstanding warrants or other obligations against each fund.  At the close of the term of office he shall make out a full exhibition of his debits and credits as such Clerk-Treasurer, and turn over to the successor in office all the moneys or evidence of deposits, books, and other property of the town, taking receipt for the same, subject to verification thereof by the State Board of Accounts.
      (12)   The Clerk- Treasurer shall be an ex officio member of the Town Council to the extent only that in case of a tie vote, he shall cast the deciding vote.
      (13)   The Clerk- Treasurer shall perform all other duties as is provided by law for the offices of Clerk and Treasurer of the town.

   (C)   The following general rules shall be established for the operation of the Clerk- Treasurer's Office:
      (1)   The office may be closed for attendance by the Clerk and Deputy-Clerk at district, state and national meetings and workshops and at any other appropriate time as requested by the Clerk-Treasurer and approved by the Town Council.
      (2)   The office hours shall be as follows: Monday through Friday 8:00 a.m. until 5:00 p.m.
