§ 90.01  DEFINITIONS.
   For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   ANIMAL CONTROL AUTHORITY.  The Animal Control Authority shall consist of at least three members appointed by the Town Council, and including the Clerk- Treasurer, the Town Marshal, and one member of the Town Council or the Humane Society.
   ANIMAL SHELTER.  Any premises designated by action  of the town for  the purpose of impounding and caring for animals found running at large in violation of this chapter.
   AT LARGE.  Any animal shall be deemed to be at large when off the property of the animal's owner and not under the control of a competent person.
   EXPOSED TO RABIES.  An animal has been exposed to rabies within the meaning of this chapter if it has been bitten by, or has otherwise been possibly infected by, any animal known to have been infected with rabies.
   HUMANE SOCIETY.  The Huntington County Humane Society, Inc., or its successor-in- interest.
   KENNEL.  Any entity in the commercial business of breeding, buying, selling or boarding animals other than as food for human consumption, within the town.
   OWNER.  Any entity keeping an animal or animals coming within the provisions of this chapter.
   RESTRAINT.  An animal is under restraint within the meaning of this chapter if controlled by a leash, at "heel" beside a competent person and obedient to that person's commands, on or within a vehicle being driven or parked on the streets, or within the property limits of the animal's owner or keeper.
