§ 54.03  RULES, REGULATIONS AND OPERATIONS.
   (A)   All governmental, business, professional and residential recyclables, compostables, garbage and rubbish to be collected pursuant to this chapter shall be placed for collection by the owners or producers in approved bundles or approved containers which shall then be placed conveniently for the collection at ground level, within five feet adjoining an improved and passable alley, where there is an alley, or if there is not alley at an easily accessible spot within five feet of the front curb line at times and on collection days to be established by the town.
   (B)   No more than three approved containers and/or bundles of garbage and/or rubbish need be collected from any collection unit on any single collection day.
   (C)   All recyclables shall be reasonably clean and free of foreign matter and placed for collection by the owners or producers thereof in approved recycling containers which shall also be placed for periodic collection as provided in division (A) above, and otherwise in accordance with those then in force related policies as are adopted and published as legal notices from time to time by the Town Council.
   (D)   Approved bundles and approved containers shall not be placed for collection earlier than 5:00 p.m. on the day prior to the collection day established by the town.
   (E)   Approved containers shall not remain at the collection point after 6:00 p.m. on the day of collection.
   (F)   No person shall convey or haul over the streets, alleys or public places of the town any garbage or rubbish unless the vehicle containing it has a box bottom with tight-fitting ends, sides and bottom, properly closed and tight-fitting, and covered with a lid, screen, wire mesh, tarpaulin or other cover which is sufficient to prevent its contents from falling or blowing upon the streets, alleys or other public or private property in the town.
   (G)   No person shall burn or cause to be burned in the open air outside of a dwelling house or other building within town limits unless the material so burned is burned in an Environmental Protection Agency or Indiana Department of Environmental Management approved incinerator of such type and construction as shall prevent any ash or embers from it from flying or scattering and becoming a fire hazard and endangering surrounding property to damage by fire.
