§ 53.78  WASTEWATER SURCHARGES.
   (A)   Liability for surcharge. Each user shall be subject to a surcharge, in addition to the regular sewer charges, if they discharge wastewater or any other substances into the POTW that have constituent concentrations greater than the following:
      (1)   A CBOD of 200 mg/l.
      (2)   A TSS content of 200 mg/l.
      (3)   A phosphorus content of 12 mg/l.
      (4)   An ammonia-nitrogen content of 15mg/l.
      (5)   A FOG content of 100 mg/l.
   (B)   Computation of surcharge. The surcharge shall be determined as follows: The amount the constituent concentration levels identified in division (A) of this section are exceeded will be determined on the basis of pounds with the surcharge computed by first multiplying the user’s sewage volume, as determined for billing purposes, measured in units of 100 cubic feet for the applicable billing period by the factor 0.0062321 and then multiplying this product by the difference between (a) the concentrations measured in mg/l of the CBOD and of the suspended solids respectively in the user’s wastewater and (b) the allowed concentrations. The surcharge for each constituent will then be determined by multiplying the excess pounds of each constituent by the rate of surcharge specified in division (C) of this section.
   (C)   Rates of surcharge. The rate of surcharge shall be as follows:
      (1)   For CBOD:  $.21 per pound.
      (2)   For TSS:  $.32 per pound.
      (3)   For phosphorus:  $1.29 per pound.
      (4)   For ammonia- nitrogen:  $.97 per pound.
      (5)   For FOG:  $.22 per pound.
