§ 157.149  APPEALS.
   (A)    Appeals from the enforcement and interpretation of this chapter, and applications for special use permits or variances shall be filed with the Planning and Zoning Administrator, who shall transmit all such records to the Board of Adjustment within 30 days.
   (B)   The Board of Adjustment shall fix a reasonable time, not to exceed 30 days, from the receipt of the records as noted in § 157.148(A) for the hearing of the appeal and publish notice of such hearing in a newspaper of general circulation in the county at least five working days prior to the hearing.
   (C)   The Board of Adjustment, by a vote of at least four of its five members, may reverse any order, requirement, decision, or determination of the Planning and Zoning Administrator, or may decide in favor of the applicant a matter upon which the Board is required to pass under this chapter, or may grant a variance from the provisions of this chapter.
   (D)   Each decision of the Board of Adjustment is subject to review by the County Superior Court. Any appeal to the Superior Court shall be taken within 30 days after the decision of the Board of Adjustment is filed in the Office of the Zoning Administrator, or after written copy of the decision is delivered to the appellant by registered mail, return receipt requested, whichever is later.
