§ 152.38  UTILITY REQUIREMENTS.
   (A)   An accessible, adequate, safe, and potable water supply of water for domestic purposes shall be provided in each park. Where a municipal water supply is available of satisfactory quantity, quality, and pressure and located within 500 feet of the park, connection shall be made thereto and its supply used exclusively.
   (B)   When a municipal water supply is not available, a water supply shall be developed for each lot within the park. Systems comprising of at least four spaces or lots, but not more than 14 spaces or lots, shall be required to submit water supply system plans to the Division of Environmental Health of the county’s Health Department.
   (C)   When a municipal water supply is not available and the system comprises more than 15 or more spaces, water system plans shall be required to be submitted to the state’s Department of Environmental Health and Natural Resources (EHNR) for approval.
   (D)   Sewage disposal facilities shall comply with the following.
      (1)   (a)   Adequate and safe sewage disposal facilities shall be provided in all manufactured/mobile home parks. A sewer collection system shall be connected to a public or community sewerage system when such a system is available and within 500 feet of a park. When such a connection to a public or community system cannot be made, individual septic systems may be provided if the county’s Health Department finds that the soil, topography, and groundwater conditions are favorable.
         (b)   All sewage disposal systems shall be designed, constructed, and approved in accordance with the regulations governing sewage disposal systems in the county, promulgated by the county’s Board of Health; or where applicable, under the provisions of G.S. § 130A-335, the rules and regulations promulgated by the state’s Department of Environmental Health and Natural Resources. The regulations governing sewage disposal systems in the county are on file at the office of the Health Director and the Clerk of Superior Court of the county. The provisions of these regulations and all amendments, adopted by reference in accordance with the provisions of G.S. § 153A-47, shall become part of this chapter as full as if set out herein.
      (2)   (a)   Each space or lot within the park shall be provided with at least a four-inch diameter sewer connection pipe where collection systems are provided. The slope of any portion thereof shall be at least one-fourth inch per foot and shall consist of one pipe line only without any branch fittings. The sewer riser pipe shall be so located on each space that the sewer connection to the home drain outlet will approximate a vertical position, shall extend at least four inches above ground level and shall have a concrete apron installed around riser pipe at grade level. The apron shall be a minimum of four square feet in area, (approximately two feet by two feet square), and shall be a minimum of four inches in thickness.
         (b)   All joints in a sewer connection pipe and sewer riser pipe shall be water tight and shall be constructed of similar and approved materials. Pipe used for sewer riser and sewer connection piping shall be semi-rigid, corrosion-resistant, non-absorbent, and durable. The inner lining shall be smooth.
      (3)   Provision shall be made for plugging the sewer pipe when a home does not occupy a space. Surface drainage shall be diverted away from the riser.
   (E)   Solid waste disposal facilities shall comply with the following:
      (1)   The storage, collection, and disposal of solid waste in a manufactured/mobile home park shall be conducted as to create no health hazards, rodent harborage, insect breeding areas, accident or fire hazards, or pollution.
      (2)   All solid waste containing garbage shall be stored in standard fly-tight, watertight, rodent-proof containers with a capacity of not more than 32 gallons which shall be located not more than 150 feet from any home site. Containers shall be provided in sufficient number and capacity to properly store all solid waste containing garbage. The park management shall be responsible for the proper storage, collection and disposal of solid waste.
      (3)   Stands shall be provided for all containers. Such container stands shall be so designed as to prevent containers from being tipped, to minimize spillage and container deterioration, and to facilitate on-site maintenance.
      (4)   All solid waste containing garbage shall be collected at least twice a week. Where suitable collection service is not available from municipal or private agencies, the park owner shall provide the service. All solid waste containing garbage shall be collected and transported in covered vehicles or covered containers to a site or landfill approved by the County Health Department.
   (F)   Grounds, buildings and structures shall comply with the following:
      (1)   Grounds, buildings and structures shall be maintained free of insect and rodent harborage and infestation. Extermination methods and other measures to control insects and rodents shall conform to the requirements of the County Health Department.
      (2)   Parks shall be maintained free of accumulation of debris and abandoned motor vehicles which may provide rodent harborage or breeding places for flies, mosquitoes, rats and other similar pest.
      (3)   Storage areas of all items of a temporary nature such as lumber, pipe and other building materials stored for immediate use for construction shall be so maintained as to prevent rodent harborage; and shall be stored at least one foot above the ground.
      (4)   Storage of all items of a permanent nature shall be in an approved portable container.
      (5)   As the potential for insect and rodent infestation exist, all exterior openings in or beneath any structure shall be appropriately screened with wire mesh or other suitable materials approved by the county’s Hearth Department. The underside of all homes, buildings, and structures shall be underpinned or skirted of a material approved by the County Building Inspector within 90 days after the home, building, or structure has been placed and/or set up on the lot or space.
      (6)   The growth of brush, weeds, and grass shall be controlled to prevent harborage of ticks, chiggers, snakes, and other noxious insects or reptiles and to prevent the spread of fire. Parks shall be so maintained as to prevent the growth of ragweed, poison oak, poison ivy, poison sumac, and other noxious weeds considered detrimental to health. Open areas shall be maintained free of heavy undergrowth of any description.
   (G)   All streets within the park shall be adequately illuminated from sunset to sunrise. The minimum size street light shall be a 175 watt mercury-vapor (approximately 7,000 lumen class), or its equivalent and spaced at intervals not to exceed 300 feet.
