529.04 LIQUOR CONSUMPTION IN MOTOR VEHICLE.

(a) No person shall consume any beer or intoxicating liquor in a motor vehicle. This section does not apply to persons described in Section 529.07 (d).

(b) Whoever violates this section is guilty of a misdemeanor of the fourth degree. If, however, the offense was committed on school premises or within 1,000 feet of the boundaries of any school premises, violation of this section is a misdemeanor of the second degree.
