5.57.040: MEDICAL MARIJUANA BUSINESS LICENSE:
City of Warr Acres may issue a business license to any business wishing to operate as a retail establishment, commercial grower, processor and/or transporter subject to the following conditions:
A.   Possession of a City business license shall not authorize the license holder to engage in activities that are not authorized for their license(s) that the business has been issued by the State.
B.   Possession of a City business license authorizes the holder to engage in said business only in a zoning district where the commercial activity is explicitly authorized as a permitted use or use subject to review under the Warr Acres Zoning Code.
C.   City issued licenses under this chapter are non-transferable.
D.   Applicants for a business license must provide evidence of a current State license or proof that the applicant's application for a State issued license is pending. City may issue conditional licenses to applicants if the State requires proof of satisfaction of local requirements. Such conditional licenses shall not authorize the holder to engage in any commercial activities related to the growth, processing, transportation or retail sale of medical marijuana until such time as the applicant has been issued a State license.
E.   City issued licenses are deemed revoked to the extent the license holder's State issued license is invalidated or otherwise revoked due to any State legislative enactment or as a result of any administrative process by the State administrative agency tasked with enforcement of the State licenses. To the extent a City-license holder's State-license is suspended or otherwise invalidated for a temporary period of time, the City issued license shall also be deemed suspended. City may suspend or revoke any City issued license as provided herein.
F.   Applicants for a City business license for a medical marijuana business shall submit the following to the City:
   1.   State-issued identification evidencing that the applicant is twenty five (25) years of age or older;
   2.   Proof of residency in the State of Oklahoma;
   3.   A list of all members, managers, and board members with proof that all are Oklahoma residents. Applicant may show ownership of non-Oklahoma residents, but that percentage ownership may not exceed twenty five percent (25%). All applicants must disclose all ownership;
   4.   Proof that the applicant is registered to conduct business in the State of Oklahoma;
Licenses issued pursuant to this chapter shall be effective for one year. Applications for renewal shall include all information which is required for first time applicants. (Ord. 1188, 2018)
