5.55.060: APPLICATION FOR A MOBILE FOOD SERVICE ESTABLISHMENT LICENSE:
A.   Application: Single event or multiple event application forms shall be made available by the city inspector to apply for each mobile food service establishment license. The applicant shall provide the following:
   1.   Photocopies of current Oklahoma state and Oklahoma County inspections and certificates.
   2.   Photocopy of Oklahoma state sales tax permit.
   3.   Photocopy of food service operator's certificate.
   4.   Photocopy of vehicle owner driver's license for identity purposes.
   5.   Photocopy of the affidavit that was provided to the county health department affirming that you are a U.S. citizen or legal resident of the United States.
   6.   Photocopy of Oklahoma state department of health license that must be posted on the outside of the unit.
   7.   A description of area of the city where the special event will be held, and remains at one physical address for no more than twelve (12) hours at one time unless in conjunction with a festival (OAC 310:257-17-3).
   8.   A description of areas of the city where the festival will be held, and vendors may remain at one physical address overnight should the festival run over a one to three (3) day period.
B.   Submission Of Materials: Each application shall indicate on its face, in addition to other requirements as may be determined by the committee, that the following materials must be submitted by the applicant:
   1.   The name of the business and its owner or owners and the mailing address of the business. A letter from the owner of the property granting permission to businesses to hold a special event.
   2.   A description of the proposed location for the mobile food service establishment operation, and name of the special event or festival coordinator.
   3.   A proposed service hours of operation with a detailed schedule of times and locations where the mobile food establishment will be stationary and serving food (time should match the times the business is open and be no longer than 12 hours or in case of a festival daily hours).
   4.   OCCHD certificate of inspection. It shall be a requirement where the event organizer of special events or festivals shall contact the supervisor of the customer protection department (CPD) of the OKC-County health department, within ten (10) days of the event with a complete list of vendors. This will allow the customer protection department to make sure they have all the proper licenses and if not, the CPD can coordinate inspectors to go to the location and issue the proper licenses. The CPD is responsible to ensure food is delivered in a safe manner with proper licenses. Additional inspections of the food service establishment may be required by the city of Warr Acres fire department and city inspector prior to granting any license.
   5.   Proof of access to restroom facilities with flushable toilets and access to hand washing facilities for the use of the mobile food service establishment employees within three hundred feet (300') of each location where the establishment will be in operation for more than one hour in any single day.
   6.   A certificate of insurance providing general liability insurance listing the city as additionally insured. A food service establishment license shall be issued only for the explicit time period covered by the effective dates of the general liability insurance policy.
C.   Approval Process: An application must be submitted to the city inspector, who shall review all application documents for completion, based on duly published criteria established by this chapter and the Oklahoma City-County health department, prior to its final approval and the issuance of a license by the city inspector.
   1.   The committee, at the request of the commissioner, may work with the applicant or license holder to modify a service location at any time: a) before the issue of a license or b) after the issue of a license, if the grant of a license or approval of a service location has led to the creation of a nuisance or otherwise endanger the public health, safety, or order or by request of the license holder.
   2.   Completed applications shall be submitted thirty (30) days before the special event or festival to the city inspector, who will either issue or deny the application for a license.
   3.   If the application is denied in whole or in part, the city inspector shall state the specific reasons for the denial. Any applicant who has been denied a license may appeal such denial by submitting a written request for a hearing to the commissioner within ten (10) days of denial. Such hearing shall be conducted by the commissioner or his or her designee or committee within thirty (30) days of receipt of said appeal. The decision resulting therefor shall be final and subject only to judicial review. (Ord. 1157, 2015)
