§ 2-121 SWINE AND CHICKENS.
   (a)   It shall be unlawful for any person to keep or rear any swine within the corporate limits of the city.
   (b)   Except where prohibited by subdivision covenants, conditions and restrictions, it shall be lawful to keep, permit or allow domesticated chickens within the corporate limits of the city under the following terms and conditions.
      (1)   No chickens shall be permitted upon properties other than single-family detached residential lots or tracts, and no more than four hens shall be allowed for each single-family dwelling.
      (2)   No roosters shall be allowed.
      (3)   There shall be no outside slaughter of chickens.
      (4)   All chickens must be kept at all times in a secure enclosure, maintained in a neat and sanitary condition at all times and cleaned on a regular basis so as to prevent offensive odors.
      (5)   Enclosures must not be located in front or side yard setback areas as defined by the city’s zoning ordinance, and must be located at least 25 feet from any neighbor’s home.
      (6)   Enclosures must be constructed in accordance with city policies maintained by the Code Enforcement Officer, and shall be subject to all applicable permit and construction requirements of the city’s zoning ordinance and city adopted construction codes.
      (7)   All production from the chickens raised must be consumed on the premises.
      (8)   All persons desiring to keep chickens within the city must obtain a permit from the office of the Code Enforcement Officer. Such permit shall be for the calendar year or portion thereof, and shall be renewed annually during the month of December for the subsequent calendar year. In cases where the keeper of the chickens is not the property owner, written consent of the property owner is required before a permit or permit renewal will be issued. Enclosure plans and the location of the chickens shall be inspected initially by the Code Enforcement Officer prior to issuing a permit, and following application for renewal. The keeper shall further allow access to the location for inspection at other times within 14 days following contact with the permit holder, whenever the Officer has reason to believe that these conditions are not being met.
      (9)   The application for a permit to keep chickens and application for renewal of the same shall be accompanied by a fee of $20 per calendar year.
      (10)   Any person who keeps chickens in violation of these terms and conditions shall be subject to a penalty of $50 per day that the violation persists, and may further be required to remove the chickens.
