The city shall not be liable to any consumer of electricity for failure to provide electricity or for damages resulting from low voltage or power surges unless the city is grossly or wantonly negligent or intends to create damages to the electric customer or consumer. The city does not guarantee the delivery of electricity through any of its conductors at any time except only when its interconnections, generators, conductors and transformers are in good working order and the peak electrical capacity of the system is sufficient for the usual peak demand of its consumers.

Before work is commenced in a new electrical system area, the developer shall prepare, or cause to be prepared, for submission to the Superintendent for his or her approval, a new electrical system plan, which shall consist of a drawing on a plat of the area of the electrical system proposed to be installed. The drawing shall indicate the approximate location and size of underground primary wires, transformers and street lights. If overhead construction is proposed, the drawing shall indicate the approximate locations and sizes of poles, wires, transformers and street lights. Before any materials are procured or installed as hereinafter provided, the plan shall be approved by the Superintendent.

The developer of any property contained within a new electrical system area shall pay to the city the cost of all materials necessary to complete the new electrical system. The cost of materials charged to the developer shall include the cost of materials used to connect the new electrical system to an existing portion of the electrical system of the city even though the connection may be outside the new electrical system area. The cost of construction of feeder lines from the power plant or other similar points shall not be charged to the developer.
