(a) (1) It shall be unlawful for any person or firm to engage in the business or occupation of pruning, treating or removing trees within the city without first applying for and procuring a license. Qualifications for the license and operating procedures shall be formally adopted by the Tree Board. Qualification for a license shall include satisfactorily completing a competency test administered by the city staff. Revocation of the license may be made by the Tree Board upon a hearing before the Tree Board.
(2) The license fees shall be $500 for the remaining portion of the calendar year for which application is made, to be paid in advance; provided, however, that no license shall be required for any city employee doing such work in the pursuit of their public service endeavors.
(3) Applicants shall procure and maintain a liability insurance policy in the amount of $1,000,000 covering bodily injury and property damage on a combined single limit basis and indemnifying the city or any person injured or damaged resulting from the pursuit of such endeavors as herein described. Such policies of insurance shall be issued by an insurance company authorized to do business in the State of Kansas.
(4) An arborist may qualify as to the insurance requirements by filing a certificate with the city executed by the resident agent of such company, stating that the required policy of insurance has been issued by such company for the purpose required by this article and that such insurer will not cancel the policy except upon giving 30 days of notice in writing to the city. The arborist license is to be purchased at the City Clerk’s office.
(b) The city burn site is designated for residential use and city licensed arborists only.
