§ 11-102 AMENDMENTS TO THE UNIFORM PUBLIC OFFENSE CODE.
   The following provisions, as adopted by the Uniform Public Offense Code shall be amended to read as follows:
   (a)   Excessive noise from a motor vehicle.
      (1)   Excessive noise from a motor vehicle is any sound produced by a sound amplification system from within a vehicle on a street, highway, alley, parking lot or driveway, whether public or private property, which can clearly be heard at a distance of 50 feet or more. The measurement standard shall be by the auditory senses, based on a direct line of sight. A sound amplification system means any radio, tape player, compact disk player, loud speaker or other electronic device used for the amplification of sound.
      (2)   Operating or permitting the operation of an sound amplification system so as to produce excessive noise from a motor vehicle is a Class C violation.
   (b)   Jake brakes, exhaust cutouts or similar devices.
      (1)   A JAKE BRAKE is any device commonly known by that name, or similar device used to slow a motor vehicle by engine compression.
      (2)   Operating, causing or allowing to be used any jake brake, exhaust cutout or other similar device which causes other than ordinary exhaust noise to be emitted from the vehicle is a Class C violation.
   (c)   Smoking and the like. References to “smoke”, “smoking”, “tobacco shops” and “smoke-free” shall be construed to include “vape”, “vaping”, “vapor shops” and “vapor-free”, respectively, under Sec. 10.24. Smoking Prohibited, Sec. 10.25. Smoking; Posting Premises and Sec. 10.26 Smoking Prohibited; Penalties or amendments thereto, of the currently adopted and effective edition of the Uniform Public Offense Code incorporated by reference under § 11-101; where to VAPE or VAPING is defined as the use of any electronic or battery-powered device/vaporizer, such as an e-cigarette, that simulates tobacco smoking or vaping by producing an aerosol that resembles smoke, vapor or any component thereof. Furthermore, VAPOR SHOPS shall mean any indoor area operated primarily for the retail sale of such devices and associated products, and VAPOR is the emission of such devices.
