(a) The manufacture, sale and discharge of fireworks in the city shall be governed by the Rules and Regulations of the State Fire Marshal, as set forth in the Kansas Administrative Regulations at 22-6-1 et seq. Such Rules and Regulations are hereby incorporated by reference as if set out in full herein.
(b) Section 22-6-5 of the Rules and Regulations of the State Fire Marshal incorporated in division (a) above is hereby amended to read as follows:
The discharge or firing of fireworks is allowed only on the following days and times each year: on July 1, 2, and 3 between 8:00 a.m. and 11:00 p.m., on July 4 between 8:00 a.m. and 11:59 p.m., and on July 5 between 8:00 a.m. and 10:00 p.m., provided, however, that no fireworks shall be discharged or fired in any public places, i.e., city parks, streets, alleys or public parking areas. Provided further, however, that the governing body may issue special permits for fireworks displays on special occasions to civic or patriotic organizations or to public school officials, upon written application, only if the applicant agrees that such display shall be open to the public and subject to the supervision and direction of the Fire Chief.
