(a) A temporary installation of an above-ground storage tank, not to exceed 500 gallons capacity, for flammable, combustible or hazardous liquids, may be permitted by special permit from the Fire Department. The temporary tank must meet NFPA 30 requirements. The temporary tank permit is good for a maximum of 60 days, and extensions may be granted by the Village Fire Safety Officer or Fire Chief for a time period to be determined by the Village Fire Safety Officer of Fire Chief.
(b) A property owner may apply for a permit to permanently install an above-ground storage tank for flammable, combustible or hazardous liquids. The application for a permanent tank must be made to the Planning Commission, and plans must comply with the following requirements of the Fire Department and the Building Department:
(1) Only vaulted tanks are permitted;
(2) The tank must meet or exceed NFPA 30, 30A, 31 and 70 requirements;
(3) The tank must meet or exceed UL 2085 requirements;
(4) The Village Fire Safety Officer will determine the type of crash protection required individually by site;
(5) Vaulted tanks must have interstitial space leak detection with audible and visual alert;
(6) The tank area is to be surrounded by screening or fencing that has been approved by both the Building and Fire Department. Approved crash protection shall be installed in all areas with motor vehicle access. No drains are permitted in the enclosure;
(7) The above-ground storage tank owner shall provide the Fire Department with enough foam to fight a fire involved with the tank. The amount and type of foam is to be specified by the Fire Department;
(8) The tank must be installed on concrete pads only as specified by the Building Department;
(9) The proposed site must be approved by the Fire Department;
(10) The anchoring of the tank is required as specified by the manufacturer;
(11) Permanent above-ground fuel tanks are only allowed in an industrial zoned district;
(12) In an industrial zoned district, permanent above-ground tanks not in excess of 2,000 gallons may only be installed with a minimum buffer area of 200 feet from the boundary of any residential area;
(13) In an industrial zoned district, permanent above-ground tanks in excess of 2,000 gallons, but less than 12,000 gallons, require a minimum buffer area of 200 feet plus an additional 50 feet for every 1,000 gallons over 2,000 gallons from the boundary of any residential area;
(14) For permanent above-ground tanks with a capacity of more than 2,000 gallons, but not more than 12,000 gallons, only diesel fuel or liquid with a flash-point equal to or greater than that of diesel fuel may be stored. There shall be no above-ground storage of gasoline.
(15) For purposes of this section, the term “residential area” shall refer to the shortest distance between the storage tank in question and the closest residential lot line.
