1490.37   COST OF ABATEMENT.
   (a)   When the Building Inspector causes the abatement for corrections to violations of any of the laws of the state law or federal law or the Village ordinances as prescribed in Section 1490.09(e), a statement of the costs thereof shall be mailed to the owner of such land by certified mail, return receipt requested. Such statement of cost shall include the following:
      (1)   Administrative, supervision and re-inspection charges;
      (2)   Testing laboratory/agency charges;
      (3)   Transportation of equipment charges;
      (4)   Owned or rental of equipment charges;
      (5)   Equipment operator charges;
      (6)   Disposal charges;
      (7)   Labor charges;
      (8)   Incidental charges.
   (b)   When the Building Inspector causes the abatement of weeds, grasses, vines or rank vegetation to be cut and/or the removal and disposal of cut weeds, grasses, vines or rank vegetation or the removal and disposal of debris, leaves or litter as prescribed in Section 1490.09(c) and the Village performs the corrections, the minimum fees to be charged shall be in no case less than one hundred fifty dollars ($150.00) for each man-hour or portion thereof. Additional charges such as equipment charges, fuel charges, re-inspection fees, administrative charges or incidental charges may apply.
   (c)   When the corrections are performed by a private contractor provided by the Village, the minimum fees shall be as follows:
      (1)   First offense, all charges incurred by the Village or the private contractor plus an additional fifty dollars ($50.00).
      (2)   Second offense, all charges incurred by the Village or the private contractor plus an additional seventy-five dollars ($75.00).
      (3)   Third offense, all charges incurred by the Village or the private contractor plus an additional one hundred dollars ($100.00).
      (4)   Fourth or more offense, all charges incurred by the Village or the private contractor plus an additional one hundred fifty dollars ($150.00).
      (5)   Additional charges such as re-inspection(s), administrative charges or incidental charges may apply.
   (d)   The Building Department shall make a written return to the County Auditor of its action under subsections (b) through (d) of this section with a statement of all charges and a proper description of the premises. Such amounts shall be entered upon the tax duplicate and be a lien upon the lands from and after the date of the entry and be collected as other taxes and returned to the Village with the General Fund. Such remedy shall be in addition to the penalty provided in division (e) of this section.
   (e)   Whoever violates this section is guilty of a minor misdemeanor. A separate offense shall be deemed committed each day during or on which a violation occurs or continues.
