The Board of Zoning Appeals shall hear and determine all appeals from the refusal of the Inspector of Buildings, because of anything contained in this Building and Housing Code, to issue permits or certificates of occupancy, or from any decision or action of the Inspector in the administration of this Building and Housing Code.
Any person, firm or corporation may appeal from the decision or action of the Inspector in the enforcement and administration of this Building and Housing Code to the Board within ten days after the date of such decision or action, by filing with the Board a written notice of such appeal. The Board shall hear and determine such appeals within twenty days after the filing thereof.
When so appealed to, and after public notice and hearing, the Board may, with the concurrence of not less than three of its members, grant a variance from any provision of this Building and Housing Code in any case, if the enforcement of such provision would do manifest injustice and would be contrary to the spirit of the Building and Housing Code and to the public interest. The granting of such a variance shall be subject to any conditions and safeguards as may be established by the Board. The Inspector shall act in accordance with the decision of the Board.
The Board shall hold meetings subject to the call of the Mayor. All meetings shall be public, and the minutes of all meetings shall be kept showing the attendance of members and the vote or failure to vote of each member on each subject. The Board may adopt from time to time such rules as it may deem necessary to carry into effect the provisions of this Building and Housing Code and/or to exercise its powers and functions.
