1026.02   PLANTING, REMOVING, ETC.; PERMIT REQUIRED.
   The Street Commissioner shall have full jurisdiction, authority and control in the issuance of permits as provided for herein.
   No person shall plant, remove, destroy, cut, prune, treat, feed, break, climb, injure or spray any tree existing on any public place in the Village, or authorize or procure any person to do so, or remove or tamper with any device placed for the protection of a tree, or attach any rope, wire, chain, sign or other device to a tree, or authorize or cause the same to be done, without first obtaining a written permit therefor from the Commissioner.
   The permit, when granted for the planting of a tree on a public place in the Village, shall designate the species of tree, the required spacing, the minimum planting size and the type of support. No person shall guy a tree of less than four inches in caliper with wire or rope. For trees over four inches in caliper, special permission must be obtained and the permittee must assume liability for incidents occurring therefrom.
   The application for a permit shall state the number and kind of trees to be trimmed, sprayed, preserved, removed or planted, the kind of treatment to be administered and such other information as the Commissioner finds reasonably necessary to a fair determination of whether or not a permit should be issued.
   The Commissioner shall supervise all work done under a permit and may affix reasonable conditions to a permit. The Commissioner may waive issuance of a written permit if the application, in his or her opinion, is for relatively minor work.
