886.01   PERMIT REQUIRED.
   All persons wishing to construct, operate, maintain, reconstruct and/or rebuild a system within the Village for the purpose of delivering telecommunications services and/or other utilities to residents, businesses or other premises within the Village must first obtain a telecommunications and utility right-of-way permit from the Building Department in the form and in conformity with the requirements set forth in Section 886.02. The acceptance fee for said permit shall be as stated in Subsection 2.3 of the permit form referred to in Section 886.02.

886.02   FORM OF PERMIT.
   The form of the telecommunications and utility right-of-way permit required under this chapter shall be as shown on "Exhibit 1" attached to original Ordinance 1997-13, passed September 2, 1997, and made a part hereof.

886.03   AMENDMENT OF PERMIT AFTER GRANT.
   Any telecommunications and utility right-of-way permit granted under this chapter may be amended only in accordance with Subsection 18.1 of the permit form referred to in Section 886.02 and only in writing and by ordinance enacted by Council.

886.99   PENALTY.
   Whoever violates any of the provisions of the chapter, or any provision of a telecommunications and utility right-of-way permit granted under this chapter, is guilty of a misdemeanor of the first degree and shall be fined not more than one thousand dollars ($1,000) or imprisoned not more than six months, or both, for each offense. A separate offense shall be deemed committed each day during or on which a violation occurs or continues.
