432.435   USE OF MOBILE TELEPHONE WHILE DRIVING.
   (a)   No person shall operate a motor vehicle while holding for use a mobile telephone on the public roadways. As used in this section, "mobile telephone" means any cellular, analog, wireless and digital telephone.
   (b)   Division (a) of this section does not apply to a person who is using the mobile telephone to contact the public safety forces; while maintaining the vehicle in the park position or with a "hands-free device".
   (c)   Whoever violates this section shall be guilty of a minor misdemeanor.
