260.15   PENSION PICK-UP PLAN.
   (a)   For the categories of Village employees listed in subsection (d) hereof, the contribution required to be made by each said employee to the Ohio Public Employees Retirement System (OPERS) or the Police and Firemen's Disability and Pension Fund, as applicable, as an employee contribution under Ohio R.C. 145.47 and Ohio R.C. 742.31, respectively, shall be paid by the Village on behalf of the employee in lieu of a contribution by the employee in accordance with the provisions of this section.
   (b)   No employee's total compensation shall be increased. Each employee's compensation shall consist of two parts: a "cash salary" shall be the total compensation payable by the Village to each said employee in any pay period, reduced by the amount payable by the Village to OPERS or the Police and Firemen's Disability and Pension Fund on behalf of each said employee under subsection (a) hereof. Each employee's "deferred amount" shall be the "pick-up" amount payable by the Village under subsection (a) hereof, in lieu of a contribution by the employee.
   (c)   The provisions of this section shall apply to all employees in the categories listed in subsection (d) hereof, and no such employee shall have the option to receive direct payment of the amounts contributed by the Village to OPERS or the Police and Firemen's Disability and Pension Fund on his or her behalf instead of having them contributed to OPERS or the Police and Firemen's Disability and Pension Fund.
   (d)   This section shall apply to all Village employees, whether full-time or part-time, who are currently covered by OPERS, whether hourly or salaried, including, but not limited to, elected officials, appointed officials, the Village Solicitor and/or Prosecutor, any other employees who are currently covered by OPERS and any and all employees covered by the Police and Firemen's Disability and Pension Fund.
   (e)   The Mayor, or his or her designee, and the Fiscal Officer, are hereby directed to take all acts necessary and appropriate to initiate implementation of the provisions of this section, including, but not limited to, making applications to the Internal Revenue Service for private letter rulings concerning Federal tax treatment of the OPERS and Police and Firemen's Disability and Pension Fund pick-up plans, and making application to the OPERS Board and the Police and Firemen's Disability and Pension Fund Board.
   (f)   Subject to any requirements imposed by the Internal Revenue Service, the OPERS Board and the Police and Firemen's Disability and Pension Fund Board, the provisions of this section shall apply to all payroll payments payable by the Village to the employees set forth in subsection (d) hereof, effective with the payroll payable on or after January 1, 1990, provided that the same shall be effective only so long as they are approved by the OPERS Board or its agents, or the Police and Firemen's Disability and Pension Fund Board or its agents.
