260.06   SICK LEAVE.
   (a)   (1)   All employees designated as full-time with a scheduled work week of not less than forty hours, shall be entitled to sick leave of one and one-fourth days for each completed month of employment by the Village after April 30, 1968.
      (2)   "Sick leave" shall be defined as an absence with pay necessitated by:
         A.   Illness or injury to the employee;
         B.   Exposure by the employee to a contagious disease communicable to other employees; or
         C.   An illness in the employee’s immediate family.
(Ord. 1996-22. Passed 11-5-96; Ord. 2008-42. Passed 12-16-08.)
   (b)   Unused sick leave for full-time, non-bargaining employees shall be cumulative. As a one-time benefit to employees of the Village, unused sick leave may be converted by an employee who retires from the Village and the Ohio Public Employees Retirement System or the Ohio Police & Fire Pension Fund on the basis of 55% of the accumulated time. This one-time payment is made at the time of retirement and is based on the employee’s rate of pay at that time. It eliminates all sick leave credit accrued but unused by the employee at the time payment is made.
   In the case of the death of a full-time employee with ten or more years of service with the Village, the Village shall pay, in cash, to the employee's heirs or estate, one-half the value of such employee's accrued but unused sick leave credit. The payment shall be based on the employee's rate of pay at the time of death and eliminates all sick leave credit accrued but unused by the employee at the time payment is made.
(Ord. 1993-10. Passed 3-16-93; Ord. 2003-4. Passed 2-4-03; Ord. 2009-28. Passed 11-10-09.)
   (c)   No sick leave in excess of three consecutive days shall be allowed unless such employee furnishes evidence satisfactory to the Mayor that the illness complained of is of longer duration. The Mayor shall have the right to require a physician's report and/or diagnosis of such employee's condition at any time.
(Ord. 1968-16. Passed 6-18-68.)
   (d)   Illness in the immediate family of such employee, requiring the attention of such employee, shall entitle such employee to two days of sick leave for each such illness. For purposes of this section of the Codified Ordinances, the term "immediate family" shall be defined as the employee's spouse, child, sibling, parents, parent(s)-in-law, grandparent(s), grandparent(s)-in-law, step-parent(s), or step-children.
(Ord. 2008-42. Passed 12-16-08.)
   (e)   In the event of the death of an employee's spouse, child or parent or the parent of a spouse, brother, sister, stepfather, stepmother, stepbrother, stepsister, grandparents, grandchildren and stepchildren, such an employee shall be entitled to three days funeral leave. In the event of the death of an employee's brother-in-law or sister-in-law, such employee shall be entitled to one day funeral leave, subject to approval of the Chief of Police and/or the Mayor, and upon approval shall not be time charged against any accumulated sick time earned.
(Ord. 1987-7. Passed 1-20-87.)
   (f)   The Fiscal Officer shall keep accurate records of accumulated sick leave for each such employee, as well as reports from physicians, and other data pertinent hereto.
