242.05   DESIGNATION AND APPOINTMENT OF CAPTAIN.
   (a)    From the number of full-time Sergeants employed by the Village, and the Lieutenant, if any, the designation and appointment of one such Sergeant or Lieutenant to Captain is hereby authorized.
   (b)    No Sergeant shall be eligible for designation and appointment as a Captain until he or she has served a total of five years as a full-time Sergeant for the Village.
   (c)    The designation and appointment of one Sergeant or Lieutenant to Captain shall be made by the Chief of Police, at his or her sole discretion and election, subject to approval and confirmation by the Mayor and Council. Vacancies in the grade of Captain shall be filled by appointment by the Chief of Police, at his or her sole discretion and election, from those persons determined to be eligible, which appointment shall be subject to approval and confirmation by the Mayor and Council.
   (d)   The Captain shall serve as the Executive Officer to oversee the operation of the Police Department in the absence of the Chief of Police, and shall attend to all duties assigned by the Chief of Police, including Detective Bureau duties, patrol duties, or administrative duties, if assigned.
   (e)   The position of Captain in the Police Department shall be an at-will appointment, but shall not constitute an at-will employment position. The Captain shall hold the position of Captain until retirement, resignation or until removed by the Police Chief. If so removed by the Police Chief, he or she shall be entitled, unless said removal shall have been for reasons which constitute grounds for termination, to be placed back into the position/rank held by him or her immediately prior to their appointment to Captain.
   (f)   The Police Captain's salary and benefits shall be set in accordance with Chapter 260 of these Codified Ordinances, and shall also include an hourly rate for overtime as approved by the Mayor. Overtime for the Police Captain shall only be approved by the Mayor in the event that the overtime expense is paid from grant monies or donations.
