§ 90.42 EXCEPTIONS; NUISANCES.
   This subchapter shall not apply to starlings or similar type of birds found to be congregating in such numbers in a particular locality that they constitute a nuisance or menace to the health or property of any resident or property owner in the city. In the event starlings or similar type of bird increase in such numbers or are found to be congregating in such numbers as to constitute a nuisance or menace to health or property to any resident or property owner in the city, such resident or property owner may eliminate such birds after having notified the Chief of Police of the city of such condition and having received his or her permission to eliminate them. The Chief of Police or any police officer of the city shall supervise such elimination.
