(A) Animal boarding facility regulations.
(1) All such facilities shall be maintained in a manner which shall not create a public nuisance by reason of noise or emission of offensive odors, and which shall not pose a danger to human life or property.
(2) The facilities shall be of sufficient size to permit each animal housed therein to stand freely, sit, turn around and lie in a comfortable and normal position, and which are consistent with the humane treatment of animals as required by the Animal Welfare Act, 7 U.S.C. §§ 2131 et seq. An exercise area shall be maintained on the premises which provides such animals the means to exercise; however, no such animal shall be left in the exercise area overnight.
(3) Each animal housed in the facility shall be seen at least once during each 24-hour period by the animal caretaker.
(4) Excrement shall be removed from the primary enclosures or restraining area as often as necessary to prevent contamination, reduce disease hazards, minimize odors, and in compliance with all state and federal laws.
(5) Each animal housed in the facility shall be fed a nutritionally adequate meal on a daily basis in accordance with commonly accepted practices or consistent with the instructions from a veterinarian.
(6) Storage of all supplies shall be maintained in such a manner to prevent vermin infestation and to minimize the chance for disease.
(7) Each animal housed in the facility shall be given a sufficient amount of water to drink on a daily basis in accordance with commonly accepted practices or consistent with the instructions from a veterinarian.
(8) Each animal shall be restrained, when necessary, in a manner which prevents entanglement with other animals and with devices that are designed for such purposes which are properly fitted.
(9) All animals shall be properly inoculated against rabies and any other necessary diseases and proper documentation thereof shall be maintained.
(10) Said facility shall be clean at all times.
(11) Said facility shall be subject to inspection by the city at any reasonable time for compliance.
(B) Permits.
(1) No person shall operate an animal boarding facility without first obtaining a permit in compliance with this section.
(2) The permit period shall begin with the first day of the calendar year and shall end on the last day of the calendar year. Renewal applications for permits may be made within 60 days prior to the expiration date.
(3) Annual permits shall be issued upon payment of the following applicable fees:
(a) For each facility housing ten or less animals, the sum of an amount to be set by the City Council from time to time; and
(b) For each facility housing more than ten but less than 20 animals, the sum in an amount to be set by the City Council from time to time, per year.
