Because hazardous waste creates unusual problems, difficulties, and dangers to the city, state, and nation and their respective citizens, public, and residents, and because it is not feasible to determine a rate which should be charged for the collection and disposal of hazardous waste, in lieu of setting a schedule of rates, the rate shall be a matter of negotiation between the parties involved. In those situations where the city, in order to protect the public generally, is compelled to act to require the collection, removal, and disposal of hazardous waste, the City Council may determine in each instance the appropriate rate which may be charged to the generator of waste by the sanitation service company removing and disposing of the hazardous waste.
