(A) If a judgment of conviction is entered, suspended, or deferred, the Clerk of the Court shall assess such fines, deferral fees, warrant fees, and costs of confinement as the Municipal Judge shall impose in accordance with state law for all offenses, and shall tax the costs of the case unless waived by the Judge, all of which the defendant shall pay.
(1) Court costs. Pursuant to 11 O.S. § 27-126, as amended, court costs shall be in an amount to be set by the City Council from time to time plus witness and mileage fees, per case and may be added to the fine. All funds collected shall be deposited in the appropriate fund.
(2) Additional fees, costs, and assessments will be added to the court costs an fines and may include:
(a) Twenty-five dollars administrative warrant fee;
(b) Fifty dollars deferral fee;
(c) One-hundred dollars failure to appear fee.
(B) For every fine, fee, or bond forfeiture collected by the Municipal Court of the city, additional local and state-mandated fees, costs and penalty assessments shall be collected as provided in 20 O.S. §§ 1313.2 through 1313.4, as amended, and as provided in other applicable state law.
(C) Cost related to prisoner confinement.
(1) In addition to the other allowable costs, the Municipal Court, at its discretion, may require that a person confined in the county jail, both before or after conviction, upon conviction, or receiving a deferred sentence in lieu of a fine, pay to the Court Clerk of the Municipal Court, the contract account owed to the County Sheriff’s office for the cost of incarceration of the individual as provided by 22 O.S. § 979a.
(2) At the discretion of the Municipal Court, in addition to incarceration costs, any and all costs associated with medical care, dental care, psychiatric services, and other costs expended for health services provided to the municipal prisoner will be collected from the individual.
(3) The individual shall pay to the Clerk of the Municipal Court all costs of incarceration. The Clerk shall then pay the monies to the City Treasurer for any payments required by law.
