§ 85.03 BARRIER REQUIREMENTS.
   (A)   Application. The provisions of this chapter shall control the design of barriers for outdoor residential swimming pools. These design controls are intended to provide protection against potential drownings and near-drownings by restricting access to swimming pools.
   (B)   Swimming pool. A swimming pool shall be provided with a barrier which shall comply with the following:
      (1)   The top of the barrier shall be at least 48 inches above grade measured on the side of the barrier which faces away from the swimming pool. The maximum vertical clearance between grade and the bottom of the barrier shall be two inches measured on the side of the barrier which faces away from the swimming pool;
      (2)   Openings in the barrier shall not allow passage of a four-inch diameter sphere;
      (3)   Maximum mesh size for chain link fences shall be one and one-quarter inch square unless the fence is provided with slats fastened at the top or the bottom which reduce the openings to not more than one and three-quarter inches; and
      (4)   Access gates shall comply with the requirements of divisions (B)(1) and (B)(2), and shall be equipped to accommodate a locking device.
