§ 156.196  CONDITIONAL USE PERMITS.
   (A)   The Town Board of Adjustment shall issue a conditional use permit for all two-family and multi-family developments that contain two or more structures located on the same parcel or on separate parcels but that are developed and planned together.
   (B)   The Board of Adjustment shall issue a conditional use permit only after having evaluated an application and having determined that:
      (1)   The use will not materially endanger the public health or safety if located where proposed and developed according to plan;
      (2)   The use meets the all required conditions and specifications;
      (3)   The use will not substantially injure the value of adjoining or abutting property or that the use is a public necessity;
      (4)   The location and character of the use, if developed according to the plan as submitted and approved, will be in harmony with the area in which it is to be located;
      (5)   The viability and character of the surrounding neighborhoods will not be adversely impacted;
      (6)   The proposed use will serve in the town’s best interests and shall substantially add to the quality and diversity of the town’s housing stock;
      (7)   The streets and driveways as proposed provide adequate circulation for on-site and off-site vehicular movement; and
      (8)   The existing and/or proposed public infrastructure, including, but not limited to, streets, water and sewer, is adequate to serve the site.
