§ 156.123  PERMITTED USE TABLE.
   (A)   Permitted use table.  See below.
   (B)   Conditional uses. 
      (1)   The following list of conditional uses shall only be permitted upon the approval of the Board of Adjustment after the Board finds that all the requirements of this chapter are met. All conditional uses considered by the Board of Adjustment shall not adversely affect the surrounding land uses in terms of appearance, safety, property values and other effects, which would normally be realized if such a use, were located in a particular area.
      (2)   The Board of Adjustment may also attach additional conditions when permitting such uses within such proposed zoning district.

Notes
1   Churches and their customary related uses including cemeteries, provided that all buildings and graves shall be set back at least 20 feet from any property line.
1(a)   Churches and church bulletin boards, lighted or unlighted, not exceeding 50 square feet.
2   Customary accessory uses and structures including private garages, swimming pools and other accessory structures in the rear yard where they shall not cover more than 30% of said rear yard.
2(a)   Accessory uses and buildings customarily or necessarily incident to any of the above specified uses, including private swimming pools, tennis courts and noncommercial truck farm. An accessory use shall be situated on the same lot or contiguous premises as the primary use to which it is accessory.
2(b)   Uses customarily accessory to permitted uses, but not to include open-air storage.
3   Kindergartens and day care facilities provided they comply with the applicable state regulations, provided that not less than 100 square feet of play area is provided for each child, and provided further said aggregate play space is surrounded by a sturdy fence at least four feet in height.
4   Provided they meet the same lot and yard requirements as site built homes.
5   Public works and public utility facilities such as transformer stations (utility towers), pumping stations, water towers (storage tanks) and telephone exchanges, provided:
      such facilities are essential to the service of the community and no vehicles or materials shall be stored on the premises;
      all buildings and apparatus shall be set back at least 20 feet from all property lines and shall be designed and landscaped in such a way to blend in with the surrounding area (*This section was changed from a permitted use to a conditional use November 13, 2001).
5(a)   Public utility substation, utility towers, pumping stations, storage tanks, provided that each of the above uses is set back a minimum of 25 feet from any exterior property line and provided that natural evergreen screening is used.
6   Rest and convalescent homes not used primarily the treatment of contagious diseases, alcoholics, drug addicts or psychotics.
7   Public safety facilities such as fire and police stations and rescue squad headquarters, provided that all vehicles and equipment shall be stored indoors; provided further, that all buildings shall be set back at least 20 feet from all property lines and shall be designed and landscaped in such a way as to blend in with the surround area.
8   Rear yard parking or storing of not more than one unoccupied travel trailer, camping trailer, motorized home, pickup coach, self- contained travel trailer and/or boat.
9   Public primary and secondary schools, colleges, universities and private schools having the same curriculum as ordinarily given in the public schools.
10   Two family and multifamily dwellings, subject to the conditions and dimensional requirements.
11   Provided all provisions of §§ 156.135 through 156.144 are met.
12   Restaurants and drive-in restaurants; provided such drive-in restaurants are fenced on all sides which abut residential zones to a height of at least six feet.
13   Automobile sales, service and body repair garages, provided however, a used car or used truck lot shall not be a permitted use except in conjunction with and as a part of a franchised new car or truck dealership.
