§ 156.053  PERMANENT SIGNS LIMITED.
   (A)   Notwithstanding § 156.049 and in addition thereto, the following permanent signs shall be permitted without a zoning permit:
      (1)   Historical markers, regulatory signs, public interest signs and warning signs erected and maintained by the town or state or an agent of such;
      (2)   On-premises directional signs not exceeding four feet in height nor two square feet in area;
      (3)   Identification signs not exceeding two feet in height nor two square feet in area;
      (4)   Incidental signs;
      (5)   Flags on permanent poles;
      (6)   Any sign not legible or easily noticeable from public property or a public right-of-way and obviously not intended to attract the attention of the public;
      (7)   Any public notice or warning required by a valid and applicable federal, state or local law, regulation or ordinance; and
      (8)   Traffic control signs on private property, the face of which meets Department of Transportation standards and which contain no commercial message of any kind.
   (B)   Notwithstanding § 156.049 and in addition thereto, the following permanent signs shall be permitted upon the issuance of a valid zoning permit:
      (1)   Any sign not expressly listed as permitted without a permit shall require the issuance of a valid zoning permit prior to installation; and
      (2)   Off-premises privately owned and maintained directory signs that provide a directory to businesses, uses or attractions not on the immediate property but at nearby development sites may be placed on private property provided that:
         (a)   The directory sign shall serve to direct the public to a single development site or contiguous development sites;
         (b)   The property on which the directory sign is located is immediately adjacent to the businesses, uses or attractions advertised;
         (c)   The directory sign does not exceed five feet in height nor 24 square feet in sign area;
         (d)   The property on which the directory sign is located does not contain another directory sign;
         (e)   The directory sign is not located within 50 feet of another permanent, privately owned freestanding sign;
         (f)   No more than one such directory sign is erected to direct the public to the development site(s);
         (g)   The directory sign does not obstruct the clear sight triangle or in any other way interfere with the safe passage of vehicles, pedestrians and bicyclists on, off of or along public streets, sidewalks or bike paths; and
         (h)   If the directory sign is lighted, it shall be designed as a knockout backlit sign.
