§ 155.038  FINAL PLAT.
   (A)   Review procedure.
      (1)   The subdivider shall submit copies of the final plat to the Administrator at least 14 days prior to the regular meeting of the Planning Board. During this 14-day period, the Administrator shall review the document and determine whether or not the final plat substantially agrees with the approved preliminary plat and construction plans. If substantial differences exist, the plat shall be submitted to the Planning Board as a new preliminary plat.
      (2)   Substantial changes shall include, but are not limited to the following:
         (a)   Changing the number of lots; or
         (b)   Creating a new street.
      (3)   After the Planning Board receives a properly prepared final plat, it shall approve or disapprove the final plat within 45 days after first consideration; otherwise, the plat shall automatically be approved.
   (B)   Appeal. If the subdivider disagrees with the Planning Board, he or she may appeal to the Town Board of Commissioners, provided the appeal is made within 30 days after the official action of the Planning Board. The appeal shall be submitted to the Administrator in writing who shall forward it the Town Board of Commissioners at its next regular scheduled meeting.
   (C)   Number of copies and graphic media. Twelve paper copies shall be submitted to the Administrator.
   (D)   Scale and size of sheets. The final plat shall be of a size suitable for recording with the County Register of Deeds and shall be at a scale of not less than one inch equals 200 feet. Maps may be placed on more than one sheet with appropriate match lines.
   (E)   Authorized preparer of final plat. The final plat shall be prepared by a surveyor or engineer licensed and registered to practice in the state.
   (F)   Administrative fees. At the time of submittal of the final plat, the subdivider shall pay the town a filing fee as established by the Town Board.
   (G)   Certifications required. The final plat shall contain the following certifications before it is submitted to the Administrator.
      (1)   Certificate of ownership and dedication.

   (H)   Contents of final plat. The final plat shall substantially conform to the preliminary plat as it was approved. It shall also conform to the provisions of plats, subdivisions and mapping requirements as set forth in the G.S. § 47-30, as amended, and the Standards of Practice of Land Surveying in North Carolina. It shall depict or contain the information specified in §§ 155.050 through 155.055. (Plats not illustrating or containing the information required shall be returned to the subdivider, or his or her authorized agent, for completion and resubmission.)
   (I)   Disposition of final plat. One reproducible copy shall be signed and executed as required for recording by the Register of Deeds within 30 days after approval by the Planning Board. One copy shall be recorded in the Register of Deeds office. The subdivider shall also submit a paper copy to the Administrator after the plat has been recorded.
   (J)   Plan submittal time limit. The initial phase(s) shall be submitted not more than 12 months after the date on which the preliminary plat was approved; otherwise, the approval of the preliminary plat shall be null and void. In that case, the preliminary plat shall be resubmitted as if it were a new subdivision.
   (K)   Phase development. The final plat shall represent only that portion of the preliminary plat that the subdivider plans to record.
   (L)   Resubdivision procedures. For any replatting or resubdivision of land, the same procedures, rules and regulations shall apply as required for the original subdivision.
   (M)   Recording final plat. The subdivider shall be responsible for recording the final plat in the County Register of Deeds office within 30 days after final approval. A paper copy of the recorded plat shall be given the Administrator by the subdivider within five working days after recordation.
