(A) Review procedure. The subdivider, or his or her authorized agent, shall submit 12 copies of the preliminary plat of the total project, even if the project is planned in phases, to the Administrator at least 21 days prior to a regular meeting of the Planning Board. During this period, the planning review staff, consisting of the Administrator and other appropriate personnel as deemed necessary by the Town Manager, shall evaluate the plat to determine whether or not it meets the requirements of this chapter. The Administrator may receive comments from outside experts and agencies directly impacted by the project. The comments from the planning review staff, along with those from any outside experts or agencies, shall be submitted to the Planning Board. The Planning Board shall approve, approve conditionally or disapprove the plat within 45 days after first consideration; otherwise, the plat shall be deemed automatically approved. (If the plat is approved conditionally, the 45-day timeline starts over.) If the preliminary plat is not submitted to the Administrator at least 21 days prior to the regular meeting of the Planning Board, the plat may not be submitted to the Planning Board until their next regular meeting.
(B) Appeal. If the subdivider disagrees with the Planning Board, he or she may appeal to the Town Board of Commissioners, provided the appeal is made within 30 days after the official action of the Planning Board. The appeal shall be submitted to the Administrator in writing who shall forward it to the Town Board of Commissioners at their next regular scheduled meeting.
(C) Number of copies and graphic media. The subdivider shall submit, at least, 12 black or blueline prints of the preliminary plat to the Administrator. If more copies are required, he or she may request additional copies be submitted.
(D) Scale and size of sheets. The preliminary plat shall be at a scale of not larger than one inch to 200 feet and be drawn on a sheet with an outside dimension of not more than 18 inches by 24 inches.
(E) Authorized preparer of plats. The preliminary plat shall be prepared by a surveyor or engineer licensed and registered to practice in the state.
(F) Administrative fees. At the time of submission of the preliminary plat, the subdivider shall pay to the town a filing fee as established by the Town Board.
(G) Contents required. The preliminary plat shall depict or contain the information specified in §§ 155.050 through 155.055 and other applicable provisions of these regulations. If the project is to be done in phases, the entire project shall be shown on the preliminary plat with each phase indicated. (Plats not illustrating or containing the information required shall be returned to the subdivider or his or her authorized agent for completion and resubmission).
(H) Action by the Planning Board. If the preliminary plat is approved without any additional conditions, the subdivider shall submit construction plans prepared by a licensed engineer to the Administrator. If approved conditionally, a revised plat showing the required changes shall be submitted to the Administrator for verification prior to submitting any construction plans. If the preliminary plat is disapproved, the Planning Board shall specify the reasons for such action in writing. One copy of such reasons shall be returned to the subdivider and one copy retained by the Administrator. When a preliminary plat is disapproved, the subdivider may make the recommended changes and submit a revised preliminary plat to the Administrator within 60 days after the Planning Board action.
