§ 33.02 BLACKOUT PROCEDURES.
   (A)   The Mayor is authorized and directed whenever a state of war exists between the United States of America and any foreign country or nation to proclaim and publish rules and regulations which shall have full force and effect of law of the conduct and cooperation of persons, firms, corporations and agencies. The rules and regulations may include black out, light up or lighting distribution rearrangement, including the intensity and distribution of all street, residential, commercial and other lighting. The rules and regulations may further include those protecting fire, police, health, highways and the general protection of the public and may require drills and practice exercises. The Mayor may require any inhabitant or any organization of the town to aid in enforcing rules and regulations, and the services of non-residents may be accepted as voluntary help in the discretion of the Mayor. The Mayor may also request assistance from organizations such as the County Defense Council, the Red Cross, the State Guard, the Highway Patrol and other state and national organizations.
   (B)   The Mayor may appoint or recommend for appointment by the Regional Defense Council a Coordinator of Volunteer Emergency Service. The Coordinator shall direct the preparation and execution of disaster plans and volunteer emergency services in cooperation with the regional and state defense councils and, if the authority is so delegated by the Mayor, the name of the head of this organization shall be the Air Raid Warden for the town. The Air Raid Warden shall have full power and authority to appoint and select deputy air raid wardens as are qualified under division (A) above.
   (C)   Special lighting of an emergency nature, such as black out, light up, lighting distribution rearrangement or change in general lighting intensity, shall be placed in effect on receipt of an order that the action is necessary or desirable from the Governor of the state of the District Warning Center or other legally constituted proper authority to the Mayor or the Air Raid Warden or any designated Deputy Air Raid Warden, Coordinator of Volunteer Emergency Service and Chief Control Officer.
   (D)   It shall be unlawful to refuse or neglect to obey any of the rules and regulations as proclaimed by the Mayor or to refuse or neglect to obey any order of the Mayor in connection therewith or any order made on any person, firm, corporation and agency for aid in enforcing the same.
   (E)   This section shall constitute an exercise by the town of its government functions for the protection of the public peace, health and safety and neither the town or any person, firm, corporation or company responding to the regulations lawfully proclaimed and published by the Mayor or called upon to assist in enforcing the same, shall be involved in a suit in damages in connection with the same.
