§ 31.41 DEPOT COMMISSION.
   (A)   Establishment. Pursuant to G.S. § 63-53, there is hereby created the Town Depot Commission, which shall be organized and have the duties and powers hereinafter set out.

   (B)   Members; terms.
      (1)   The Depot Commission shall have 12 members, to be appointed by the Town Council. In the initial appointment, the Town Council shall appoint five members for the terms of three years and five members for terms of two years. Thereafter, all appointments shall be for terms of three years.
      (2)   A member of the Depot Commission shall be designated by the Council as Chairperson of the Depot Commission.

   (C)   Powers and duties. The Depot Commission shall have the following powers and duties:
      (1)   To operate, maintain and regulate the town depot, subject to any limitations set out in this section;
      (2)   To lease real or personal property either from or to private individuals, subject to approval by resolution of the Town Council; and
      (3)   To develop plans and make recommendations to the Town Council for the future use and development of the town depot.
