(A) Establishment. There is hereby created a commission to be known as the “Recreation Commission” of the town, in accordance with G.S. § 160A-354.

(B) Members, terms and vacancies.
(1) The Recreation Commission shall be composed of nine members to be appointed by the Council.
(2) Members appointed shall serve for a term of four years and until their successors are appointed and qualified.
(3) Vacancies in the Recreation Commission shall be filled for the unexpired term by the Council. The members of the Recreation Commission shall serve without compensation.

(C) Officers, rules and meetings.
(1) The Recreation Commission shall appoint from its membership a Chairperson and such other officers as it may deem necessary for the orderly procedure of its business.
(2) It may adopt bylaws, rules and regulations covering its procedure not inconsistent with the provisions of state law.
(3) The Recreation Commission shall, from time to time, make rules and regulations governing the operation and conduct of the recreational facilities operated by town employees.
(4) The Recreation Commission shall hold regular meetings at such places and times as it may designate.

(D) Entering into contract or binding obligation. The Recreation Commission shall have no authority to enter into any contract or incur any obligation binding upon the town other than current obligations or contracts to be fully executed within the then current fiscal year and all within the budget appropriations made by the Council of the town.
