(A) The Building Inspector is hereby appointed to administer and implement this chapter by granting or denying development permit applications in accordance with its provisions.
(B) Duties of the Local Administrator shall include, but not be limited to, the following:
(1) Review all development permits to assure that the permit requirements of this chapter have been satisfied;
(2) Review all development permits to determine if proposed development adversely affects the flood-carrying capacity of the floodplain. For purposes of this chapter, ADVERSELY AFFECTS means damage to adjacent property because of rises in flood stages attributed to physical changes of the channel and the adjacent overbank areas.
(a) If it is determined that there is no adverse effect and the development is not a building, then the permit shall be granted without further consideration.
(b) If it is determined there is an adverse effect, then technical justification (such as a registered professional engineering analysis) for the proposed development shall be required.
(c) If the proposed development is a building, then the provisions of this chapter shall apply.
(3) Advise permittee that additional federal or state permits may be required and, if specific federal or state permits are known, require that copies of the permits be provided and maintained on file with the development permit;
(4) Notify adjacent communities and the State Department of Crime Control and Public Safety Division of Emergency Management, State Coordinator of the National Flood Insurance Program, prior to any alteration or relocation of a watercourse and submit evidence of the notification to the Federal Emergency Management Agency;
(5) Assure that maintenance is provided within the altered or relocated portion of the watercourse so that the flood-carrying capacity is not diminished;
(6) Verify and record the actual elevation (in relation to mean sea level) of the lowest floor (including basement) of all new or substantially improved structures, in accordance with § 155.20 of this chapter;
(7) Verify and record the actual elevation (in relation to mean sea level) to which the new or substantially improved structures have been flood-proofed, in accordance with § 155.36 of this chapter;
(8) When flood-proofing is utilized for a particular structure, the Local Administrator shall obtain certification from a registered professional engineer or architect, in accordance with § 155.36 of this chapter;
(9) Where interpretation is needed as to the exact location of boundaries of the areas of special flood hazard (for example, where there appears to be a conflict between a mapped boundary and actual field conditions) the Local Administrator shall make the necessary interpretation. The person contesting the location of the boundary shall be given a reasonable opportunity to appeal the interpretation, as provided in this subchapter;
(10) When base flood elevation data has not been provided in accordance with § 155.05 of the chapter, then the Local Administrator shall obtain, review and reasonably utilize any base flood elevation data available from a federal, state or other source including data developed pursuant to § 155.35 of this chapter, in order to administer the provisions of this chapter; and
(11) All records pertaining to the provisions of this chapter shall be maintained in the office of the Local Administrator and shall be open for public inspection.
