In cases where adequate storm water management facilities cannot be located on-site, but a suitable public storm water management facility is available off-site which has or will have sufficient capacity to accommodated the storm water runoff generated by the development, the property owner or developer shall have the option to pay the town a fee comparable to the cost of installing on-site facilities. Fees approved and accepted by the town for off-site storm water management may be used by the town for land acquisition (including easements and rights-of-way), as well as the study, engineering, design, purchase, construction, expansion, repair, maintenance, landscaping and/or inspection of public storm water management devices.
