§ 154.03 DEFINITIONS.
   For the purpose of this subchapter, the following definitions apply unless the context clearly indicates or requires a different meaning.
   APPLICANT. An owner or developer who has or intends to apply to the town for the necessary permits to allow construction or development of a site located within the planning or zoning jurisdiction of the town.
   AUTHORIZED REGISTERED PROFESSIONAL. A professional engineer, registered land surveyor, landscape architect or other professional who is registered, licensed or certified pursuant to the general statutes and who is authorized by law to prepare plans and specifications and to oversee the construction of a storm water control device required under this chapter.
   BMP or BEST MANAGEMENT PRACTICE. A structural or non-structural management-based practice used singularly or in combination to reduce point source or non-point source inputs to receiving waters for the purpose of achieving a given level of water quality in storm water runoff or to control the quantity thereof.
   CLEARING. Any activity which removes the vegetative ground cover from a site.
   DEED OF CONVEYANCE. The transfer of an easement interest or fee simply title in a storm water management facility or a storm water control device to the town.
   DEVELOPER. A person undertaking any or all of the activities covered by this subchapter or for whose benefit such activities are commenced or carried on. General contractors or subcontractors or both, without a proprietary interest in a project, are not included within this definition.
   EROSION. The process by which the ground surface is worn by the action of wind, water, ice or gravity.
   EROSION AND SEDIMENT CONTROL MEASURES. A system of structural and vegetative measures that minimize soil erosion and off-site sedimentation. This term, where appropriate, shall include storm water management and control measures.
   EXCAVATION. Any act or the conditions resulting therefrom by which soil, earth, sand, gravel, rock or similar material is cut into, dug, quarried, uncovered, removed, displaced or relocated.
   EXPANSION OF SITE. The addition of new buildings, structures, parking lots or any other new impervious surface to a site. Construction of any new impervious surface on an area previously impervious which does not meet the definition of redevelopment, as defined in this section, shall be considered as EXPANSION.
   FACILITY. A device or structure, including all land, materials and appurtenances used in the construction and operation of the facility, which is intended to control and manage storm water runoff. FACILITIES can include, but are not necessarily limited to, retention ponds, detention ponds, vegetative or sand filters, drainage ditches, drainage swales, check dams and the like.
   FILL. Any act or the conditions resulting therefrom by which soil, earth, sand, gravel, rock or other similar material is deposited, placed, pushed, pulled or transported.
   FLOODPLAIN. An land susceptible to being inundated by water from any source.
   GRADING. Any act causing disturbance of the earth. This shall include, but not be limited to, any excavation, filling, stockpiling of earth materials, grubbing, root mat or topsoil disturbance or any combination of such.
   HIGH DENSITY DEVELOPMENT. Development of a nature which results in a concentration of use(s) within a given area, such as apartments, mobile home parks, planned unit developments (PUDs), shopping centers (retail or wholesale outlet stores included), shopping malls, schools, industrial parks, large industrial plants or any other type of development resulting in the creation of impervious service exceeding 30% of the total land area.
   IMPERVIOUS. The condition of being impenetrable by water.
   IMPERVIOUSNESS. The degree to which a site is impervious. (Use of the following materials in the construction of buildings, structures, streets, driveways or parking areas or their related appurtenances, generally causes the imperviousness of a site to increase: asphalt; crushed stone; compacted earth; clay; wood; concrete; or metal.)
   LAND DISTURBING ACTIVITY. Any movement of earth or changes in the use of land which may result in soil erosion or the movement of sediments into waters or onto other lands including, but not limited to, tilling, clearing, grading, excavating, stripping, filling and related activities and the covering of land surfaces with any structure or impermeable material.
   NATURAL GROUND SURFACE. The ground surface in its original state before any land disturbing activity.
   OFF-SITE FACILITY. With respect to any particular property, a storm water management facility serving the property, but not located on the property.
   ON-SITE FACILITY. With respect to any particular property, a storm water management facility serving the subject property and located thereon.
   PRE-DEVELOPMENT STATE. A site in its natural condition prior to any development activity.
   PRIVATE FACILITY. Any storm water management facility not owned or operated by the town or the state.
   PUBLIC FACILITY. Any storm water management facility owned and/or operated by the town or the state.
   REDEVELOPMENT. The substantial modification of existing developed areas, not to include interior remodeling or interior modifications which do not include substantial structural modifications to a facility. When 50% of a site is being redeveloped, the entire site shall be considered as being REDEVELOPED.
   SEDIMENT. Soils transported or deposited by the action or erosion or artificial means.
   SITE. The portion of land, lot, or parcel of land or combination of contiguous lots or parcels of land upon which grading or other land disturbing activity is to be performed.
   SOIL. Any earth, sand, gravel, rock or other similar material.
   STORM WATER MANAGEMENT PLAN.
      (1)   A plan which has been submitted as a prerequisite to obtaining a zoning, conditional use or building permit from the town and which is designed to minimize erosion, prevent off-site sedimentation and control storm water runoff.
      (2)   The plan shall be prepared and designed in accordance with the requirements of this subchapter and all other state laws and regulations as may apply.
   TEN-YEAR FREQUENCY STORM. The storm of an intensity expected to occur, on average, once in a ten-year period of time, and whose duration can be expected to produce the peak rate of runoff for the watershed of interest.
   TOWN MANAGER. The Town Manager or his or her authorized representative.
   WATERCOURSE or DRAINAGE WAY. Any natural or artificial watercourse including, but not limited to: streams; rivers; creeks; ponds; lakes; ditches; channels; canals; conduits; culverts; drains; waterways; gullies; ravines; or washes, in which waters flow in a definite direction or course, either continuously or intermittently and including any areas adjacent thereto which are subject to inundation by reason of overflow or flood water.
