§ 150.04 MERCHANDISE ON STREETS.
   (A)   It shall be unlawful to display, place, cause to be placed, sell or offer for sell any article of merchandise on any street or sidewalk of the town, except as hereinafter permitted by this section.
   (B)   (1)   The following articles of merchandise and/or activities shall be excepted from the application of this section.
      (2)   Between the hours of 8:30 a.m. to 6:00 p.m., Monday through Saturday, February 15 through October 15, it shall be lawful for any established business holding a valid privilege license and having a permanent fixed location within the town to display seasonal merchandise for sale in front of and immediately adjacent to the business location upon the following terms and conditions.
         (a)   No goods or wares shall contain or, in any way, expose sharp or pointed edges so as to endanger passers-by.
         (b)   No goods, wares or the containers in which they are located shall project further than 29 inches from the outside of the exterior wall and/or window of the business structure onto a sidewalk or public access area or exceed a height of three feet, as displayed as measured from the sidewalk and/or public access area surface.
         (c)   SEASONAL MERCHANDISE shall be defined so as to include only those items listed herein: flowers; flower plants; flower pots; and plant holders.
         (d)   No display shall contain any sound amplification device nor shall any business cause any sound amplification device to be used to attract patrons or that shall cause an audible sound to be capable of being heard outside of the business structure.
