(A) For the purpose of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
HALLOWEEN TREATING. To ask, solicit or receive any candy, fruit, edible items, toys, prizes or other items of amusement.
HALLOWEEN TRICKS. For any person of any age to annoy any person by playing abusive or ridiculous tricks upon him or her; to frighten, harass or subject a person to personal indignity; or to destroy or otherwise deface any publicly- or privately-owned real or personal property owned or controlled by another person, firm or corporation.
(B) It shall be unlawful for any person of the age of 12 years or older to engage in what is known as trick or treating during Halloween or to aid or abet any other persons in this activity.
(C) It shall be unlawful for any person to engage in trick or treating after 9:00 p.m.
(D) This section shall not apply to persons who are engaged in organized charitable collections or activities, so long as such persons have in their possession signed statements by the person in charge of the charitable activity authorizing the named individual to engage in the activity which is therein specified; nor shall this section apply to organized and supervised parties or gatherings, so long as the parties or gatherings do not take place on more than one individual’s property.
