It shall be unlawful for any person, whether principal or agent, who has not engaged in a permanent business for a continuous period of at least 12 months next preceding to sell, dispose of or offer for sale at public auction or cause or permit to be sold, disposed of or offered for sale at public auction any gold, silver, plated ware, precious stones, semi-precious stones, watches, clocks, jewelry, glass, fancy china, artware, novelties, silk or woolen fabrics or furs, whether the same shall be his or her own property or whether he or she sells the same as agents or as employees of another, until the person, by applying to the Town Council, shall comply with each of the following regulations and conditions:
(A) Procure a license from the Council by paying, as a license tax, the sum of $100 for each month or fraction thereof that the person may be engaged in conducting the auction sale;
(B) File with the Town Manager a complete inventory of all goods, wares and merchandise to be offered at public auction, to be verified under oath;
(C) To file with the Town Manager a bond in the sum of $1,000, with good and sufficient surety, for the purpose of guaranteeing a compliance with the applicable terms of this chapter and the faithful performance of any contract made with the customers and purchasers at the auction sale; the bonds to remain in full force and effect for the term of 60 days after the close of the auction sale for the purpose herein provided; and
(D) Provided, however, that, this section shall not apply to judicial sales by executors and administrators, receivers or assignees in solvent and bankrupt estates, licensed pawn brokers actually selling and disposing of goods duly and regularly mortgaged or pledged, or sales by mortgages duly authorized by the terms of a bonafide mortgage or pledge.
