The town may deny an application for the following reasons:
(A) The special event time and location coincides with another special event for which a permit has been issued, and it is determined that there is a safety or logistical concern with allowing two events to proceed simultaneously. Safety or logistical concerns could include, but not be limited to, events that would burden the resources of law enforcement or emergency services personnel or would create the potential for traffic hazards;
(B) The special event will interrupt the safe movement of pedestrian or vehicular traffic at or contiguous to its location in a manner that cannot be adequately controlled by the public safety departments;
(C) The concentration of persons, animals and vehicles at assembly points for or at the location of the special event will interfere with the town’s ability to provide adequate fire, law enforcement and emergency medical services to the public;
(D) The town does not have adequate resources, equipment or personnel to protect the public health and safety during the event;
(E) If the sponsor, landowner or any principal organizers have a record of two or more permit violations in the previous two calendar years or more than two violations of state or local ordinances in the previous two calendar years resulting from the operation of a special event;
(F) For failure to present a plan that adequately addresses traffic, parking, fire safety, sanitation and other matters of concern;
(G) The town’s Planning Department determines that the event plan does not account for and protect the public health and safety needs of the citizens of the town and/or Duplin County; or
(H) The town determines the application is misleading or is attempting to circumvent the intent of the special event ordinance.
