Within 21 days from the filing of the notice of appeal, the City Council shall, with ten days’ written notice to all parties, hold a preliminary hearing to determine:
(A) Whether the appeal involved questions of law alone, and, if so, whether or not the appeal may be determined without ordering a transcript of the hearing before the Commission;
(B) Whether the appeal should be determined by listening to the recording tape;
(C) Whether a transcript of the hearing before the Commission should be ordered; or
(D) Whether the appeal is pursued frivolously without foundation, in which event, the City Council shall summarily dismiss the appeal.
