§ 112.08 EXEMPTIONS.
   The following exemptions apply to the requirements of this chapter. Unless otherwise provided by law, this chapter is not intended to restrict or prohibit the activities of the city or its agents, any peace officer lawfully engaged in the course of his or her duties, or any other individual acting under court order.
   (A)   Exemption from solicitation permit. The following individuals and activities are exempted from registering with the city and obtaining a permit to solicit or peddle within the city, but are otherwise required to comply with all other provisions of this chapter:
      (1)   Any religious or charitable organization, including individuals acting on behalf of an educational entity or public school, engaging in any activities for nonprofit purposes or soliciting charitable donations;
      (2)   Any political group engaging in activities or seeking funds or memberships;
      (3)   Any bona fide public or private auction;
      (4)   Any person, partnership, or corporation selling or dealing only with retail merchants within the city, and being exclusively wholesale sellers and dealers;
      (5)   The sale of farm, garden, art, or craft products by the persons producing or making such products;
      (6)   The sale of newspaper subscriptions; and
      (7)   Garage, yard, or similar sales of goods by individuals at their residence or place of business not exceeding three days in length nor more than twice in one calendar year, which sales shall not include business inventory.
   (B)   Exemption from background check requirement. Any applicant, having submitted to a background check and receiving a permit pursuant to this chapter, shall be exempt from re-submitting an additional background check for a period of five years.
   (C)   Other exemptions. Any applicant may petition the City Council, and, upon good cause shown, the City Council may, in its sole discretion, exempt the applicant from any or all of the background check, application fee, bonding, or permit requirements under this chapter.
