§ 93.032 VIOLATIONS.
   (A)   Any violation of the provisions of this subchapter, including the failure to properly repair or replace a deteriorated sidewalk after notice and applicable time to correct the defect has lapsed, shall constitute a new and separate offense each day the violation continues to exist. Penalties for a violation of this subchapter are outlined in divisions (B) and (C) below. Additionally, maintaining or permitting a defective sidewalk to exist, obstructing or permitting debris or other material to obstruct a sidewalk, or otherwise allowing a sidewalk to come into violation of this subchapter shall constitute a public nuisance and be subject to those processes for abatement allowable under Idaho Code.
   (B)   Any person violating the provisions of this subchapter shall be deemed guilty of an infraction and punished as outlined in § 10.99(A)(2).
   (C)   Any person violating the provisions of this subchapter having been previously found guilty of any provision of this subchapter within the five years preceding such offense shall be deemed guilty of a misdemeanor and punished as outlined in § 10.99(A)(1).
